Terms of Service

1. Acceptance of Terms

By downloading, accessing, or using the Cloudify mobile application (“Cloudify”, “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use Cloudify.

2. Description of Service

Cloudify provides cloud storage and backup features, including:

• File uploads and storage
• Optional Auto-Backup for selected media
• Storage and subscription management
• Access to different plans such as Lite and Unlimited

The Service may be updated, improved, or modified at any time, with or without prior notice.

3. Eligibility

You must be at least 13 years old to use Cloudify. By using the Service, you represent and warrant that:

• You are at least 13 years of age; and
• You have the legal capacity to enter into a binding agreement.

4. User Account

Cloudify uses Google Sign-In for authentication. By creating or using an account, you agree to:

• Provide accurate and up-to-date information;
• Maintain the confidentiality of your account and login credentials;
• Accept responsibility for all activities that occur under your account.

Cloudify is not liable for any loss or damage arising from unauthorized use of your account due to your actions.

5. User Responsibilities

You agree to use Cloudify only for lawful purposes and in accordance with these Terms. You agree that you will not:

• Upload or share content that is illegal, harmful, abusive, defamatory, or infringes the rights of others;
• Upload viruses, malicious code, or any content that could damage systems or data;
• Attempt to hack, reverse-engineer, or interfere with the security or proper functioning of the Service;
• Use Cloudify for activities that violate applicable laws or regulations.

Violation of these responsibilities may result in suspension or termination of your account.

6. File Storage & Backup

Cloudify allows you to store files and, if enabled, automatically back up specific data.

• Auto-Backup operates only when enabled by you in the app settings.
• You remain fully responsible for the content you upload or back up.
• Storage availability and limits depend on your selected subscription plan.

While we strive to keep your data safe, Cloudify is not responsible for file loss caused by device failure, corrupted uploads, user deletion, or other factors beyond our reasonable control.

7. Subscription & Payments

Cloudify offers paid plans such as the Lite Plan and Unlimited Plan. Payments are processed securely through Razorpay.

By purchasing a subscription, you agree that:

• Subscription fees and available plans may change over time with prior notice;
• Subscriptions may renew automatically based on your chosen billing cycle, unless cancelled;
• Refunds are generally not provided for partially used subscription periods;
• Premium features are available only while your subscription is active.

If you cancel your subscription, you will normally retain access to premium features until the original expiry date of your current billing period.

8. Fair Usage & Limits

Cloudify may apply reasonable technical limits and fair usage policies to ensure service quality for all users.

• Unlimited plans may use visual indicators (such as an infinity symbol) but can still have a technical storage cap for stability;
• Excessive or abusive usage that negatively affects system performance may result in restrictions or account review.

9. Termination of Service

Cloudify reserves the right to suspend or terminate your access to the Service, with or without notice, if:

• You violate these Terms;
• You engage in illegal, harmful, or abusive activities;
• Your usage causes significant risk or disruption to the Service.

You may also request account deletion at any time by contacting support@cloudifyplus.in.

10. Intellectual Property

All rights, title, and interest in and to Cloudify, including its name, logo, design, user interface, and underlying technology, are owned by Cloudify Technologies or its licensors.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, except as permitted by law or with our written permission.

11. Third-Party Services

Cloudify integrates with certain third-party services, including:

• Google Sign-In (authentication)
• Firebase Cloud Messaging (notifications)
• Razorpay (payment processing)

Your use of these services is also subject to the respective terms and policies of those third parties.

12. Service Availability

We aim to keep Cloudify available and running smoothly, but we do not guarantee:

• Uninterrupted or error-free operation of the Service;
• That defects will always be corrected immediately;
• That the Service will be free from security vulnerabilities at all times.

Maintenance, updates, or unforeseen technical issues may temporarily affect availability.

13. Limitation of Liability

To the maximum extent permitted by law, Cloudify Technologies and its affiliates are not liable for:

• Any indirect, incidental, special, or consequential damages;
• Loss of data, revenue, profits, or business opportunities;
• Unauthorized access to or use of your account due to your actions;
• Service interruptions, technical failures, or events beyond our reasonable control.

Your use of the Service is at your own risk.

14. Changes to These Terms

We may revise these Terms from time to time. When we do, we will update the “Last Updated” date at the top of this page.

Your continued use of Cloudify after any changes to the Terms constitutes your acceptance of the revised Terms.
